Terms of Service

These Terms of Service ("Terms") govern your use of Cash Game Host (the "Service"), operated by Onsight LLC, a California limited liability company ("Onsight," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Cash Game Host is a coordination and record-keeping tool for hosts who run private games. It helps you log buy-ins, cash-outs, expenses, and related notes, and to compute suggested settlement amounts between players based on what you enter.
We are not a gambling operator, sportsbook, casino, or games-of-chance provider. We do not take bets, rake, or stakes, and we do not pay or receive winnings. You are solely responsible for ensuring that your use of the Service and any games you run comply with all applicable laws and regulations in your location.
We are not a payment processor, money transmitter, bank, or escrow provider. We do not process, transmit, or hold player funds. Any payments between people (for example via Venmo, Cash App, PayPal, Zelle, cash, or other methods) occur entirely outside the Service. Features that link to or open third-party payment apps or websites are provided for convenience only; your relationship with those providers is solely between you and them.
Settlement calculations and other outputs are based on data you and other authorized users provide. They are informational and may contain errors. We do not guarantee accuracy, completeness, or fitness for any particular purpose.
2. Accounts
You may need an account to use the Service. You are responsible for safeguarding your credentials and for all activity under your account. You must provide accurate information and keep it up to date where the Service asks you to do so.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Service, other users' data, or our systems;
- Use the Service to harass, abuse, or harm others;
- Scrape, overload, or interfere with the normal operation of the Service;
- Reverse engineer or attempt to extract source code except where applicable law prohibits this restriction.
4. Third-party services
The Service may integrate with or link to third-party authentication providers, hosting infrastructure, analytics, or payment apps. Those services have their own terms and privacy policies. We are not responsible for third-party services.
5. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONSIGHT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ONSIGHT OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ONSIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONSIGHT'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY), OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability will be limited to the fullest extent permitted by law.
7. Indemnity
You will defend, indemnify, and hold harmless Onsight and its officers, directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
8. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we may provide additional notice (for example, by email or in-product message) where appropriate. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
9. Termination
We may suspend or terminate access to the Service if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where preempted by U.S. federal law. You agree that the state and federal courts located in California shall have exclusive jurisdiction over any dispute arising out of these Terms or the Service, subject to any mandatory arbitration or venue rules that apply to you.
